Welcome to Nitu Travels. These Terms and Conditions ("Terms") govern your use of our website https://www.nitutravels.in and our bus rental services. By booking our services or using our website, you agree to be bound by these Terms.

1. Definitions

• "Company," "We," "Us," "Our": Refers to Nitu Travels
• "Customer," "You," "Your": Refers to the person booking our services
• "Services": Bus rental, transportation, and related services
• "Vehicle": Any bus, coach, tempo traveller, or vehicle provided by us
• "Booking": Confirmation of service reservation

2. Booking Terms

2.1 Booking Process

• Bookings can be made via phone, WhatsApp, email, or our website form
• A booking is confirmed only after receiving advance payment (20-30% of total cost)
• You will receive a booking confirmation with vehicle and driver details
• All bookings are subject to vehicle availability

2.2 Booking Information Required

• Full name and valid contact number
• Pickup date, time, and location
• Destination and itinerary
• Number of passengers
• Vehicle type preference
• Duration of rental

2.3 Minimum Booking Period

• Local Delhi: Minimum 8 hours or 80 km (whichever is higher)
• Outstation: Minimum 300 km per day
• Multi-day trips: As per itinerary discussed

3. Payment Terms

3.1 Payment Methods

• Cash payment
• Bank transfer (NEFT/RTGS/IMPS)
• UPI payments (Google Pay, PhonePe, Paytm)
• Cheque (subject to realization)

3.2 Payment Schedule

• Advance Payment: 20-30% at the time of booking confirmation
• Balance Payment: Before departure or at the end of the trip
• Corporate Clients: Monthly billing available with prior agreement

3.3 Pricing

• All prices are in Indian Rupees (INR)
• GST (5%) is extra and applicable as per government rules
• Prices are subject to change without prior notice (but confirmed bookings honor quoted price)
• Peak season rates may apply during festivals, weddings season, and holidays

3.4 Additional Charges

The following charges are NOT included in base rates and will be billed separately:

• Toll taxes, parking fees, and state taxes (actuals)
• Driver allowance: ₹500-800 per day
• Night parking charges: ₹200-500 per night (if vehicle retained)
• Entry fees for restricted areas
• Permit charges for certain destinations
• Extra km charges beyond agreed limit
• Waiting charges beyond free waiting time

4. Cancellation & Refund Policy

4.1 Cancellation by Customer

• 7+ days before trip: 80% refund of advance payment
• 3-7 days before trip: 50% refund of advance payment
• 1-3 days before trip: 25% refund of advance payment
• Less than 24 hours: No refund
• No-show: No refund

4.2 Cancellation by Company

In rare cases, we may need to cancel a booking due to:

• Vehicle breakdown or maintenance issues
• Force majeure events (natural disasters, strikes, pandemics)
• Safety concerns or regulatory restrictions

In such cases, we will:

• Provide an alternative vehicle of same or higher category, OR
• Offer full refund of advance payment

4.3 Refund Processing

• Refunds will be processed within 7-14 business days
• Refunds will be made to the original payment method
• Bank transfer charges (if any) will be deducted

5. Service Terms

5.1 Vehicle Usage

• Vehicles are for the exclusive use of the booking customer and their group
• Vehicles must be used only for the agreed itinerary
• Any change in route/itinerary must be approved by the driver/company
• Vehicles cannot be used for illegal activities or transport of prohibited items

5.2 Passenger Conduct

• Passengers must maintain decorum and respect the vehicle
• Smoking, alcohol consumption, and drug use are strictly prohibited
• Damage to vehicle interiors will be charged to the customer
• Excessive soiling may result in cleaning charges (₹1,000-5,000)
• Playing loud music or objectionable content is not allowed

5.3 Luggage

• Luggage must fit within the vehicle's storage capacity
• Excess luggage may require additional vehicle
• Company is not responsible for loss or damage to personal belongings
• Valuables should be carried by passengers themselves
• Hazardous materials, explosives, and illegal items are strictly prohibited

5.4 Driver Instructions

• Drivers are trained professionals; follow their instructions for safety
• Drivers will decide safe routes and driving speeds
• Drivers cannot be forced to drive beyond safe hours (as per motor vehicle rules)
• Driver's food and accommodation (for multi-day trips) is customer's responsibility

6. Timings and Delays

6.1 Punctuality

• Vehicles will arrive at the pickup point at the scheduled time
• Customers should be ready 15 minutes before scheduled pickup
• Waiting time beyond 30 minutes may incur extra charges (₹200-500/hour)

6.2 Delays

• Delays due to traffic, weather, or unforeseen circumstances are beyond our control
• We will inform you of any expected delays as soon as possible
• Company is not liable for missed connections due to delays

7. Liability and Insurance

7.1 Vehicle Insurance

• All our vehicles are insured as per Motor Vehicles Act
• Insurance covers vehicle damage and third-party liability
• Passengers are advised to carry their own travel insurance

7.2 Company Liability

• Company liability is limited to the cost of the service booked
• We are not liable for indirect losses, loss of business, or consequential damages
• We are not responsible for delays due to force majeure events
• Company is not liable for theft or loss of personal belongings

7.3 Force Majeure

Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to:

• Natural disasters (floods, earthquakes, storms)
• Pandemics, epidemics, or government restrictions
• Strikes, riots, or civil unrest
• War, terrorism, or political instability
• Internet or communication failures

8. Safety and Compliance

• All vehicles comply with Motor Vehicles Act and transport regulations
• Drivers hold valid licenses and undergo background verification
• Vehicles are equipped with first-aid kits and fire extinguishers
• Speed governors are installed as per regulations
• GPS tracking is enabled for safety monitoring
• Seat belts must be worn by all passengers

9. Prohibited Activities

The following activities are strictly prohibited and may result in immediate termination of service without refund:

• Transport of illegal substances, weapons, or hazardous materials
• Driving under influence of alcohol or drugs
• Overloading the vehicle beyond seating capacity
• Using vehicle for racing or dangerous stunts
• Tampering with vehicle equipment or GPS
• Harassing or abusing the driver
• Using vehicle for commercial purposes without permission
• Smoking inside the vehicle
• Any activity violating Indian laws

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Delhi, India.

10.2 Dispute Resolution Process

1. Informal Resolution: Try to resolve issues directly with our customer service
2. Mediation: If unresolved, parties agree to attempt mediation
3. Arbitration: As a last resort, disputes will be settled through arbitration in Delhi

11. Website Terms

11.1 Website Use

• Website content is for informational purposes
• Prices and availability are subject to change
• We strive for accuracy but don't guarantee error-free content
• Images are representative; actual vehicles may vary

11.2 Intellectual Property

• All content, logos, and materials on the website are owned by Nitu Travels
• Unauthorized use, reproduction, or distribution is prohibited

11.3 User Conduct

Users agree not to:

• Use the website for illegal purposes
• Attempt to hack or disrupt website functionality
• Upload viruses or malicious code
• Scrape or automate data collection
• Misrepresent identity or affiliation

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of new Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Nitu Travels regarding the use of our services.
